Justin Timberlake will be arraigned next week on charges of driving while intoxicated after a court declined to dismiss the case against him stemming from an incident last month in the Hamptons.

Timberlake’s attorney, Ed Burke, said his client was not driving drunk when he was pulled over in Sag Harbor, New York in July. He also said police have made several errors in their arrest of Timberlake, who is in Poland on tour and did not appear at Friday’s hearing.

“The police made a number of very significant errors in this case,” Burke said in a statement. “But the fact remains, he was not intoxicated and they made an error in arresting him for it. We are confident that this charge will be dismissed.”

Timberlake is expected to appear virtually at the Aug. 2 hearing.

The pop star and actor was pulled over after midnight driving through Sag Harbor last month when police stopped him and an officer determined he was intoxicated, according to court documents.

“His eyes were bloodshot and glassy, a strong odor of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot and he performed poorly on all standardized field sobriety tests,” documents say.

Timberlake told police he had one martini and was following some friends home, according to documents. He refused a breath test after being arrested and taken to a police station. Timberlake was released on bond the morning after.
